“Today was a good day for Washington’s environment, as the state Supreme Court unanimously upheld the voter-approved law that ensures that polluters pay for the clean-up of toxic sites. The Court preserved the primary funding mechanism under the Model Toxics Control Act, which is critical for public entities to catalyze cleanups, for the restoration of Puget Sound, and for the protection of natural resources across Washington.

As the lead organization that worked to help pass the original Model Toxics Control Act in 1988, it is very gratifying to see the law upheld against attacks from the petroleum industry.

WEC intervened in this case because we know that the Model Toxics Control Act protects the health of Washington’s environment and families. We are grateful to Ken Lederman and Steve Gillespie from Foster Pepper PLLC who represented us skillfully in this matter.”
